Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the NivaraX platform, mobile application, and related services ("Service") provided by Wevanta Infotech ("we", "our", "us"). By registering for or using the Service, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

NivaraX is a Software-as-a-Service (SaaS) platform designed for property management, including:

• Property, room, and floor management
• Tenant onboarding and KYC document storage
• Automated rent generation and collection
• Online payment processing via Cashfree Payments
• Maintenance request tracking
• Notice board and tenant communications
• Financial reports and analytics

3. Account Registration

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 18 years old and legally capable of entering into contracts.
• One account is permitted per company/organization. Sub-accounts (managers) are allowed as per your plan limits.
• You are responsible for all activities that occur under your account.

4. Subscription Plans & Payments

• NivaraX is offered on a subscription basis. Plans are listed on our Pricing page.
• Subscription fees are billed monthly or annually as per your chosen plan.
• Payments are processed securely via Cashfree Payments. By subscribing, you authorize recurring charges.
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
• We reserve the right to modify pricing with 30 days' advance notice to subscribers.
• Downgrade or cancellation takes effect at the end of the current billing period.

5. Trial Period

New accounts may be eligible for a free trial period as specified during sign-up. No payment is required during the trial. At the end of the trial, your account will require an active subscription to continue using premium features.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload false, fraudulent, or misleading information about tenants or properties
• Attempt to gain unauthorized access to the platform, servers, or other accounts
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to harass, defraud, or harm any individual
• Transmit viruses, malware, or any harmful code
• Circumvent, disable, or interfere with security features of the Service

7. Data & Content Ownership

You retain ownership of all data you input into NivaraX (tenant records, property details, documents, etc.). By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.

We do not claim ownership over your data. You are responsible for the accuracy and legality of the data you upload, including tenant KYC documents.

8. Data Security & Backups

We implement industry-standard security measures to protect your data. However, we recommend you maintain your own backups of critical data. We are not liable for data loss due to unforeseen technical failures, provided we have taken reasonable precautions.

9. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for losses arising from temporary unavailability.

10. Termination

• You may cancel your account at any time from your account settings.
• We reserve the right to suspend or terminate accounts that violate these Terms, without refund.
• Upon termination, your data will be retained for 30 days before permanent deletion, during which you may request an export.

11. Limitation of Liability

To the maximum extent permitted by law, Wevanta Infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We may update these Terms from time to time. We will notify you via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
